These Terms & Conditions (“Terms”) govern your access to and use of the FinWeb website and the services provided by Wavestar Holdings LLC, trading as FinWeb (“we”, “us”, “our”). By using this website or engaging our services, you agree to these Terms.
1. Use of the website
You may use this website for lawful purposes only. You agree not to misuse it, attempt to gain unauthorised access, disrupt its operation, or use it to infringe the rights of others.
2. Quotes, proposals & scope
Prices shown on this website are starting points and estimates. A binding quote, scope, and timeline are confirmed in a written proposal or agreement for each project. Work outside an agreed scope may be subject to additional fees.
3. Fees & payment
Unless otherwise agreed in writing, projects require a deposit before work begins, with the balance invoiced on milestones or completion. Invoices are due within the period stated on the invoice. Late payments may incur interest and may pause work or delivery.
4. Client responsibilities
You agree to provide content, materials, access, and feedback in a timely manner, and to ensure you have the rights to any materials you supply. Delays in providing these may affect timelines.
5. Intellectual property
- On full payment, you own the final deliverables created specifically for your project (such as your website’s custom design and content).
- We retain ownership of our pre-existing tools, frameworks, libraries, and know-how, and grant you a licence to use them as part of your deliverables.
- Third-party assets (fonts, plugins, stock media) remain subject to their own licences.
- Unless you ask us in writing not to, we may showcase completed work in our portfolio and marketing.
6. Third-party services
Our services may rely on third-party platforms (e.g., hosting, CMS, payment, scheduling, and analytics providers). Your use of those services is governed by their respective terms, and we are not responsible for their availability or actions.
7. Warranties & disclaimers
This website is provided “as is” and “as available”. While we work to high standards of craft, engineering, and editorial quality, we do not guarantee specific business outcomes such as search rankings, traffic, conversions, funding, or revenue, as these depend on factors outside our control. To the fullest extent permitted by law, we disclaim all implied warranties.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability arising from a project will not exceed the fees you paid us for that project.
9. Indemnity
You agree to indemnify us against claims arising from materials you provide or from your use of the deliverables in breach of these Terms or applicable law.
10. Termination
Either party may terminate an engagement as set out in the project agreement. Fees for work completed up to termination remain payable.
11. Governing law
These Terms are governed by the laws of the State of New York, United States, and disputes are subject to the jurisdiction of its courts, without regard to conflict-of-law principles.
12. Changes to these Terms
We may update these Terms from time to time; the “last updated” date reflects the current version.
